Esteybar Motion
An Esteybar Motion is a motion that is filed to reduce a wobbler (a crime that can be charged as either a felony or a misdemeanor) to a misdemeanor pursuant to California Penal Code 17(b). The term Esteybar motion comes from the California Supreme Court case entitled: Esteybar v. Municipal Court (1971) 5 Cal.3d 119.
